Terms of service

These terms cover the website and the Student Impact Platform. Where your institution has signed a Master Services Agreement with us, that agreement governs the service and prevails over anything here that conflicts with it.

Agreement and precedence

By using this website or the platform you agree to these terms. If you are accessing the platform with credentials issued by an institution, you also agree to that institution’s acceptable use policy.

Order of precedence: a signed Master Services Agreement, then its Data Processing Agreement, then any order form, then these terms.

Access and credentials

Platform credentials are issued by your institution, not by EduPlatter. We do not create accounts for students or staff directly, and we cannot reset a credential without institutional authorisation.

You are responsible for keeping your credentials confidential and for activity under your account. Notify your institution and support@eduplatter.com immediately if you believe an account has been compromised.

Acceptable use

You agree not to:

  • Attempt to access records for students outside your authorised scope.
  • Export or redisclose student data other than as your institution permits.
  • Probe, scan or test the security of the service without written authorisation.
  • Use the service to make an automated adverse decision about a student without human review.
  • Reverse engineer the models or attempt to reconstruct training data.

Predictions are not decisions

The platform produces probabilistic estimates. They are decision support for a qualified human, not determinations about any individual.

You agree not to use an EduPlatter output as the sole basis for an adverse academic, financial or disciplinary action. We build the product to make this difficult and we require it contractually, because a model with good aggregate accuracy still misclassifies individuals.

Institutional data and ownership

Your institution retains all rights in its data. We claim no ownership and no licence beyond what is necessary to provide the service under instruction.

Models fitted to your data are provided for your use during the term. We do not transfer them to another institution and we do not incorporate them into a general model.

You may export your warehouse contents at any time in an open format, at no charge.

Service availability

Analytics and data services operate under the availability commitment in your order form. The self-service portal may be taken offline for scheduled work; where it affects partner institutions we notify in advance.

The website itself is provided as-is with no availability commitment.

Fees

Pricing is negotiated per institution and recorded in an order form. There are no per-seat charges for advisors, no charge for exporting your own data, and no automatic multi-year escalators — any uplift is negotiated in writing at renewal.

Warranties and liability

We warrant that we will provide the service with reasonable skill and care and in accordance with the DPA. We do not warrant that any prediction is accurate for a particular student, nor that a given intervention will produce a given outcome.

Except for liability that cannot lawfully be excluded, and except for breach of the confidentiality or data protection obligations, each party’s aggregate liability is limited to the fees paid in the twelve months preceding the claim. Neither party is liable for indirect or consequential loss.

Term and termination

Either party may terminate for material breach not cured within 30 days of written notice. On termination we will, at your election, return or delete institutional data and confirm in writing.

Sections concerning data protection, confidentiality, ownership and liability survive termination.

Governing law

These terms are governed by the laws of India, and the courts at New Delhi have exclusive jurisdiction, without prejudice to any different forum agreed in a signed Master Services Agreement.
